Thank you for being part of the PHITransfer! We are announcing changes to our Privacy Policy in accordance with the new European Union data protection regulations (GDPR).
These changes will be effective as of May 25, 2018. We invite you to visit our updated Privacy Policy. Your relationship with PHITransfer will not change, as we will not sell, exchange, or rent your information for marketing or economic benefit purposes. We have mainly clarified some points in response to the new GDPR regulations:
Transparency: We provide more detailed information about the data we collect and how we use it. We also explain your alternatives and the control you have over your information, and the measures we have taken to keep it safe.
GDPR: On May 25, 2018, a new data protection regulation of the European Union (EU), the General Regulation on Data Protection (GDPR), comes into force. The GDPR gives greater control to individuals in the EU on the way in which their data is used, and establishes certain obligations that companies must comply with when processing that information. We have updated our Privacy Policy to consider these new requirements.
By continuing to use our services as of May 25, 2018, you acknowledge our updated Privacy Policy. 1. PRIVACY POLICIES AND ACCEPTANCE.
This Privacy Policy (hereinafter the “Privacy Policy “) applies to the use of services (collectively the “Services”, and each one of them a “Service “), offered or made available to internet users by PHITransfer with address of Colombia (hereinafter the “Company”), through the website www.transformativeinnovationcenter.org (hereinafter “PHITransfer” or the “Site”).
1.1. If necessary, the Company may supplement this Privacy Policy with information and/or specific terms and conditions with regard to a particular Service.
1.2. The use of the Services gives the status of “Site User” (hereinafter, the “User”) and expresses the full and unreserved acceptance by the User of each and every one of the provisions of the Privacy Policy as published by the Company at the time the User uses the Services. Accordingly, the Privacy Policy will constitute a valid and binding agreement between the User and the Company with respect to privacy. Also, the use of the Services expresses the full and unreserved acceptance by the User of the Terms and Conditions of Use of the Services (the “Terms and Conditions”) issued by the Company on the Site that are complemented by the Privacy Policy.
1.3. The Company may amend this Privacy Policy at any time. New versions of the Privacy Policy shall be notified through: (I) publication of the new version on the Site and / or (II) by email.
1.4. The User agrees to be notified of any changes to the Privacy Policy once the Company has published them on the Site and the User’s continued use of the Services after publication of this new version will be deemed acceptance of such amendment to the Privacy Policy. Accordingly, the User agrees: (I) to check the privacy policies of the Site periodically, and (II) to read any email that is sent by the Company with any modifications or new version.

2. THE SERVICES.
2.1. PHITransfer is the website hosted on www.transformativeinnovationcenter.org operated by the Company, where the Users (Organizations) may publish and spread their dreams, in order to obtain the support that enable the development and eventual implementation of them.
2.2. A Objective is the project or wish that the Organization aims to reach after the publication thereof on the Site. The Company will publish the Objective for an established and limited time. The published Objective should be aimed to achieve a unique, lawful, concrete and feasible result, in any way fit to be presented and spread within the Site in accordance with the terms and conditions stated therein.

By using this Site, either as a visitor (“User”) or as a registered user (“Registered User”), you accept the terms of this Privacy Policy, including its occasional modifications. Accordingly, your use of this site constitutes your consent to us collecting, using or disclosing personal information about you collected through the Site, as described herein. Information You Provide
If you register on the Site, we will collect certain PII about you, including your full name, mailing address, email address, telephone number, and social media information (eg, LinkedIn, Facebook). Additionally, even if you do not register, we may collect your PII in other ways, such as if you send us an electronic message through the “Contact Us” page of the Site or publish your PII on the Site.
Information Automatically Collected
When you visit the Site, certain anonymous information related to your visit is automatically collected by PHITransfer web servers. This is done through cookies, “clear GIFs” (also known as “web beacons” or “pixel tags”), or through similar technologies to collect information about you and your use of the site.
Cookies are small data files that are sent to your browser or related software from a web server that is stored on your computer or device. Cookies generally include an anonymous unique identifier and track and store your user preferences while using the Site, as well as technical information about your use of the Site.
Most browsers can be configured to inform you when a cookie has been sent to you and give you the opportunity to reject that cookie. However, rejecting a cookie may in some cases prevent your use of the Site or certain areas or functions thereof, or adversely affect its deployment or operation. We collect data from your IP address automatically. Likewise, if you access the Site from a cell phone or any other device, you may also collect the unique device identifier assigned to your device as any other transactional information from that device.

USE OF INFORMATION COLLECTED THROUGH THE SITE
We may use the PII we collect about you (as described above) to send you electronic messages, correspondence or contact you in response to a request. We may also use your PII to send you information of interest, such as details about new activities and projects of PHITransfer, funding resources, etc. We may also use your PII for reasons of record keeping within PHITransfer, and we may combine the PII we collect from you with other information, including PII and IINP obtained from other sources, including other Users, for the purpose of analysis related to the Site and the objectives of PHITransfer.
If you have requested us to receive updates via email, we may periodically send you electronic messages that promote or contain information related to the use of the Site and / or PHITransfer. When you receive an electronic message from us, you can indicate your preference to “unsubscribe” and you will no longer receive emails from us, by sending us a request to “unsubscribe” using the following link.
We use the anonymous information collected to analyze the behavior of the User to the Site and measure both the use and interest in the Site and in the services of PHITransfer. This information is used to create additional statistics, for example, when the site is accessed, the pages that refer visitors to the Site, the type of browsers used by visitors and which pages of the Site have been viewed. These statistics help us understand how the Site is used and provide us with valuable information for a future improvement of it.
THE EXCHANGE OF INFORMATION COLLECTED THROUGH THE SITE
Public Areas of the PHITransfer Site
The PHITransfer Site is also designed as an online forum for the exchange of information for the benefit of Registered Users. If you publish PII in a public area of the Site, such as a forum, blog or chat room, such PII will be visible to other visitors of the Site, who may use and disclose your PII for their own purposes. We do not exercise control over that other use or disclosure of PII by visitors to the Site published in a public area thereof, and must take into account that other visitors to the Site may collect, correlate, use and disclose PII that you have published in the public areas of the Site. By using this Site, you agree that such third-party activities are beyond the control and responsibility of PHITransfer.
Partners, Consultants and Service Providers
In the interest of improving and making effective the objectives of the Site and of PHITransfer in general, we may share your PII with our partners, consultants and service providers. For example, we may share PII with the consultants who are analyzing certain projects if it helps the consultants communicate with you, and we may share PII with the service providers that assist us in sending you material or information.
Legal Obligations of Disclosure of Information
We may disclose your PII in response to a legal process or if we understand in good faith that it is required by law, for example, in response to a court order, subpoena or a request from a law enforcement agency. We may also disclose PII to protect the security and operation of the Site or the rights of users of the Site, and to protect and protect our partners, affiliates, consultants, suppliers and suppliers against any liability, or if we have reason to believe that someone is causing or threatening to cause harm or is interfering with the rights or property of PHITransfer, or as protection against fraud.

For your protection, we will only process requests related to the IIP associated with the particular email address you use to send us this request, and we may request that you verify your identity before processing your request.
We will endeavor to comply with your request in the most reasonably fast manner possible, including any request to remove your PII from our records. We may have to keep certain information for record keeping reasons, and there may be residual information that remains in our databases and other records, which will not be deleted.
It should be noted that we are not responsible for correcting, updating or eliminating any information in the databases of third parties with whom we have already shared your IIP.
SECURITY OF DATA
We seek to protect and monitor the security and integrity of the PII collected by implementing physical, electronic and management procedures to safeguard and protect the information against damage, misuse, unauthorized access or disclosure, alteration or destruction. However, given the inherent nature of the Internet as an open vehicle for global communication, we can not absolutely guarantee that the information will be secure against the intrusion of others, such as hackers, either during its transmission through the Internet or while it is stored. in our data systems or maintained by us in any other way. This includes the information you provide us by email or direct publications on the Site, or through the “Contact Us” function of the Site. When providing information through these channels, you should take note that your transmission may not be secure while in transit and that third parties may possibly see the information in transit. In the event of a breach of the security of our data systems that may compromise the PII of our users, we will disclose this intrusion to our affected users.
DATA CONSERVATION
We will keep PII and anonymous information collected through the Site for operational, record keeping and legal purposes. We will keep your PII for the period necessary to comply with the purposes described in this Policy or in our data conservation policy, unless a longer period of data conservation is required by law.
INTERNATIONAL DATA TRANSFER
When you provide us information through the Site or in any other way, such information (including any IIP) will be processed in the United States. The data protection laws and other privacy protection laws of the United States may not offer the same level of protection as laws of other countries. By providing personal information to PHITransfer from outside the United States, either directly or indirectly through the Site or in any other way, you expressly agree to transfer your information to the United States in accordance with the protective measures described in this Privacy Policy.
PRIVACY OF MINORS
The PHITransfer Site is not aimed at minors and we do not knowingly collect or maintain any personal information from individuals under the age of 13.
LINKED SERVICES
The Site may contain links to other websites. The publication that we make of a link to any other website or place is for your convenience and does not imply our endorsement of said website or place or its content. PHITransfer does not control the websites, applications or other services operated by third parties and we are not responsible for practices related to the protection of the privacy and data of these websites, applications or other services. Therefore, we recommend that once you access that other website, application or service, you become familiar with the privacy protection policies and practices that govern that other website, application or service.
3. COLLECTION OF INFORMATION FROM USERS. GOALS.
3.1. The User agrees that the Company may collect information about the behavior of its Users using cookies, tags and other methods (such as the information provided by Users at the time of registration in the Site).
3.1.1. A cookie is a small text file through which an Internet user can be uniquely identified, and is often installed, sent or written to the computer of Internet users, when they enter certain Internet sites, in order to automatically obtain information about the behavior of these users as they surf these websites. A cookie file usually contains the name of the domain from which the cookie has been transferred, the date of creation, and an identification code. The only personal information a cookie can contain is information that the User supplies with his or her Internet surfing, such as IP address, which pages were viewed and in what order, time spent on each page, the date and time, etc. (the “Activity Information”). A cookie cannot read data from the User’s hard drive or read other cookie files created by other sites.
3.1.2. A tag is a small image located on a Web site so that the site owner, or a third party, is able to monitor who is viewing the site collecting his or her IP address, the URL of the page where the User comes from and the time when it was seen. These tags could be used together with cookies.
3.2. The Company may collect information from users to improve the quality of its services by storing User preferences and monitoring behavior trends.
3.3. The Company may also collect and/or store the number or IP address (Internet Protocol) of the Users in order to improve the quality of service it provides through the Site. The storage by the Company of the IP number of the Users’ devices allows the identification at the time of admission to their individual accounts. It also facilitates the diagnosis of any eventual connectivity problems that may happen between the Site and Users, improving the quality of the Services. For these purposes, the IP (Internet Protocol) number or address is the identification number that distinguishes an electronic device (be it a computer, a personal telephone with network access, a tablet, a PDA, etc.), which connects to a computer network (i.e. Internet).
3.4. The Company may request the User its email address (which may be its Username), Password, Name, Phone, Address, Zip Code, City, Region, and Country of residence or other information such as defines in the Terms and Conditions of the Site.
4. USE OF THE USERS’ COLLECTED INFORMATION.
4.1. The Company may collect information about Users using cookies and/or tags. The collected information may include browsing behavior, IP address, logs, and other type of information. However, the Company will not collect direct personally identifiable information from any User using cookies or tags.
4.2. The Company will use the information provided by the User, and that, which is collected by the Company, with the objective of providing better services to Users trying to meet their needs. Additionally, the information provided by a User and that which the Company collects directly on behalf of that User, may be used by the Company to establish more effective communication with Users in order to provide them with information of their interest and different offers and promotions from different suppliers of goods and/or services.
4.3. The Company will use the information provided by the User, and that, which is collected by the Company for the purpose of sending communications, promotions and advertising.
4.4. The Company may use the information provided by the User, and that which is collected by the Company, to analyze the conduct and behavior of Users in such character, its geographic location, customs and/or preferences, in order to try to improve the services and try to provide better solutions to their needs.
4.5. The Company will use the information provided by the user, and that which is collected by the Company to determine the concerns and preferences of Users in order to provide a closer and customized offer of the goods and/or products of their need.
4.6. The Company may share the information with other service companies or websites dedicated to the evaluation of the behavior of Internet Users or similar in order to improve the quality of services of the Company. Usually these companies or websites have their own privacy policies for data protection purposes. The Company will use its best efforts to ensure that the privacy of shared information is protected as best as possible. In appropriate cases, the Company will seek to sign specific agreements regarding data protection and privacy of information. Notwithstanding the foregoing, the Company shall not be liable for damages caused by such companies and/or websites in their duty of protection, confidentiality and privacy of information that they manage.
4.7. The Company will use the information provided by the User, and that which is collected by the Company, in case it is requested by courts, or national or international agencies that require it and request it in the appropriate way.
4.8. The Company is not obliged to retain information during any prescribes period and will provide for the removal thereof as it deems convenient.
5. THE SITE
5.1. The Company will not sell or rent any personal information to any third party for promotional purposes. Any person who has provided personal contact information through the Site may send an email to privacy@positivhub.org to update, delete and/or correct the personal contact information. The Company will respond to that request within 30 (thirty) days of receiving it via email.
5.2. The Site uses cookies to track Users’ patterns. In the event that a Site User does not wish to accept these cookies, he or she can set the browser to give him or her the option to accept each cookie and reject any unwanted cookie. The Site may also use cookies analysis tools, log files and tags.
5.3. The Site may contains links to other Internet sites, which are not owned by the Company. Accordingly, the Company is not responsible for the actions of these websites, to which it shall not apply this Privacy Policy. We recommend examining the detailed privacy policy of those websites to understand the procedures for collecting information and how they use and protect your personal information.
5.4. In any case, the provisions of the Privacy Policy apply to Users of the Site whether they are properly or not properly registered.
6. MINORS.
6.1. The Site and/or Services are permitted only to those who have legal age to contract and are not inhibited or otherwise legal forbidden to exercise legal acts, rights and/or obligations. Given this, minors are not allowed to enter the Site and/or the Services nor supply any personal data or other type of information.
6.2. 7. CONFIDENTIALITY AND INFORMATION SECURITY.
7.1. The Company has taken reasonable security measures to protect User information and prevent unauthorized access or modification to User information, disclosure or destruction thereof. The information collected by the Company will be kept strictly confidential. The access to personal data is restricted to those employees, contractors and representatives of the Company who need to know that information in order to operate, and develop or improve our services. The Company requires its suppliers the same standards of confidentiality. The Company does not allow access to this information to others outside the Company, except through a User’s express request.
7.2. Notwithstanding the above, considering that the internet is an open, public access system, the Company cannot guarantee that unauthorized third parties cannot eventually overcome the security measures and use Users’ information in an improper way.
8. CHANGES IN THE CORPORATE STRUCTURE.
8.1. The Company reserves the right to transfer the collected information in case of a sale or merger of the Company, or an acquisition of the main assets of the Company, or any other kind of transfer of the Company to another entity. In such a case, the Company shall take all reasonable steps in order to ensure that such information is used in a manner consistent with the Privacy Policy.
9. USERS’ RIGHTS ON THE INFORMATION.
9.1. Most browsers are initially set to accept cookies, but Users can reset their browsers to refuse all cookies or for the system to let them know when a cookie is sent. However, if cookies are disabled, it is possible that some features and services of websites may not function properly.
9.2. The Company will endeavor by all means available to facilitate the Users over which it has collected or stored personal information, the access to their personal information (“Right of Access”), as well as the possibility to rectify, modify and update this information (“Right of Rectification”), or even the cancellation of such personal information (“Right of Removal”), unless the Company can refuse such requests, in case it is required or entitled to retain such personal information in accordance to applicable law.
9.2.1. For these purposes, the User must send to privacy@positivhub.org his or her request through an email with the words “Access to Personal Data” in the subject. The Company may require such User to identify his or herself, which may be verified by the Company, as well as to provide personal information, which he or she wants to access, modify or remove.
9.2.2. The Company may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, threaten the privacy of other Users, or deemed to be impractical, or which do not require access to the information.
9.2.3. The access, rectification and removal of personal information service will be provided by the Company free of charge, except in case it would require a disproportionate or unreasonable effort, in which case an administration fee may be charged.
10. EXCEPTIONS
10.1. Notwithstanding any other provision contrary to the Privacy Policy, the Company may disclose certain User personal information, when it believes in good faith that such disclosure is reasonably necessary to:
a) Avoid legal liability.
b) Comply with legal requirements such as a search warrant, subpoena and court order.
c) Comply with a governmental or regulatory authority requirement;
d) Protect the rights, property or safety of the Company, Users, or a third.
11. THIRD PARTY SERVICES
11.1. The Company may use third-party services of which it is not responsible for the information they collect or the way they protect personal information. To this end, each of these third party services have their own privacy policies and provide, in cases when it is available, a method by which Users may opt-out.
11.2. The company may use third party links for the purpose of promoting and supporting social contribution to the world and that represent our interest in non-commercial management corresponding to the achievement of sustainable development objectives promulgated by the United Nations Organization. The company agrees to always publish the sources of information as well as respect the copyright and non-commercial use. The inputs and support material for their commercial offer will be of their own authorship or, in their absence, with the written authorization of the authors.
12.CHANGES TO THE PRIVACY POLICY
12.1. The Company may amend this Privacy Policy in case it sees it fit. In case the amendments are substantial in relation to the processing of collected personal information under the Services, they shall be notified by posting a prominent notice on this page. If the User wishes to be notified via email of such changes, it should send an email with the subject “List Privacy Policy Changes” to privacy@positivhub.org from the email address he or she wants to receive these notifications
